Gatundu South MP Moses Kuria

It is now official that Gatundu South MP Moses Kuria will appear as a witness for Deputy President William Ruto and radio presenter Joshua arap Sang at the International Criminal Court (ICC).

Lawyers for the defence Monday met Mr Kuria - who has sparked a storm with his Ruto 'fixing' claims - at Parliament Buildings where they agreed to take his statement.

The three-hour, closed-door meeting took place in the presence of Kuria and Joshua Sang's lawyers Katwa Kigen, Philemon Koech and Logan Hambrick. Kuria will reportedly meet ICC prosecution officials Wednesday.

Monday, Kuria's lawyer Danson Mungatana confirmed the defence had interviewed Kuria and the two sides had formally agreed that Kuria would appear as a witness in The Hague-based court.

The legislator, according to information availed at the end of the meeting, will write a statement to form part of the defence team's efforts to poke holes into the ICC prosecutor's case.

"Pursuant to the defence request, we had a three-hour meeting during which the defence made a request for both Sang and the deputy president and we have agreed formally that he will appear as a witness if so required," said Mr Mungatana.

But he did not divulge information on details the defence had sought from Kuria. Ruto's lawyers have also requested a meeting with Kuria tentatively on October 26.

Shyamala Alegendra, a member of the Ruto defence team, requested a meeting with Kuria on behalf of lead counsel Karim Khan, indicating their interest to interview the legislator and possibly enlist him as a witness.

"We would be grateful if you could let us know if you are willing to meet with me, on behalf of the Ruto defence team. I will be able to travel to Nairobi around October 26, if that would be convenient for you.

"I would intend to meet with you along with Grace Sullivan, from Ireland, who is a member of our team," Ms Alegendra asked Kuria in email correspondence.

Monday's meeting took place against the backdrop of claims by Kuria that he was involved in a witness-procurement scheme against Ruto.

Kuria's claims have also attracted the attention of the Office of the Prosecutor (OTP), which has scheduled a meeting with him Wednesday.
