Makueni Senator Mutula Kilonzo Junior has told a Machakos court that the death of his late father Mutula Kilonzo was not ordinary.

“It was a well-organised elimination and collaboration of either workers or people very close to him which was followed up by a massive cover up,” Mutula Jnr said.

The Senator told the court that the last time he saw his father was on April 26, 2013 and he was in good condition.

He added that on that material day his late dad was well, a little beaten because of the campaigns but he was well. 

“I did say so because he did not miss gym sessions. So he was extremely fit,” he said.

The legislator told the court that he had a meeting with the deceased at about ten o’clock.

“We were discussing strategy on his petition. I wanted him to sign his affidavit that Friday, but he told me that he would sign it on Monday,” he said.

He added that the meeting lasted about half an hour but he (the deceased) did not leave immediately.

About midday, Mutula drove off to the K-group centre which was Mutula Snr’s law firm.

He told the court that on that same day he had also requested the deceased to bring him one of the original senatorial forms for 2013 results at around 7.30pm to include it in the affidavit.

“But he wrote an SMS asking me to remind him on Sunday,” Mutula Jnr told the court adding that his late father used to do his paper work on Sundays.

Mutula Jnr says he was alerted of his dad’s illness by a farm manager then on April 27, 2013 at around 11.51am

“On arrival at KwaKyelu ranch, my father was in bed but I was shocked as the previous night at around 7.30am, he had sent me a message concerning a petition that had been filed challenging his election,” he said.

We secured a UK-based pathologist Dr Ian Koller and two other local pathologists. But pathologists and the doctors in the room could not agree on the cause of death.

He told the court that they then agreed to let Dr Koller do toxicology examination but the government pathologist argued the facilities in the country were not good enough to establish cause of the death.

“In November 2013, I received a very disturbing email from Dr Koller vowing not to sign the toxicology report unless he received sealed samples,” he said.

He added that Dr Koller concluded that the deceased had ingested a substance that caused what he described as catastrophic haemorrhage.

The senator termed the keeping of the deceased’s samples for nine days as episode two of his father’s death questioning why the samples were not sealed and why they were never told.

“There was no explanation why the as episode two of his father’s death arguing that they were not told why the samples were not sealed.

“There was no explanation why the samples of my late father remained in Nairobi for nine days and under whose custody they were, the management of Nairobi Hospital has never been questioned about the storage of those samples, and never seen the statement of who the Kuria  is and the method which they delivered the samples,” he said.

He also argued that he launched a complaint against the pathologists and recorded a statement at the Director of Public Prosecution.

“The idea was to get to know from the perspective of the investigation as to a possibility of a criminal act in the process of delivery of samples,” Mutula said.

No statement from Dr Koller, Kuria and and from Nairobi has been taken by police.

“I am greatly pained standing here doing an inquiry in which I am certain 100 per cent will not produce any result because without establishing the cause of the death, the rest of the circumstances are academic,” he told the court.

He stated that his death should not be treated so casually. Reports of the people he was close to or worked with would expose the conspiracy and explain tell of what was happening.

The Senator also said that his late father in February 2013 withdrew a case against a lady by the name Nduku who was sending him threats of eliminating him and his children.

“I was representing Nduku and the deceased withdrew the case because it transpired that Nduku’s number was being used by other people to threaten dad,” he said adding that his father had been under serious death threats from several quarters.

The inquest was before Senior Resident Magistrate Kipkirui Kibellion.
