Siaya county assembly has suspended South East Alego Member of County Assembly (MCA) for the second time.
A second petition seeking MCA Joseph Mboha to vacate office was brought to the attention of the House on May 7, 2019.
The petitioners - Sylvester Owuor, Michael Onyuowre, Shadrack Sewe, Nicholas Rajula and Francis Owino – claimed that MCA Mboha had frequently been absent from plenary sittings.
The five petitioners, in their prayers to the assembly, asked that the South East Alego seat be declared vacant.
Yesterday, the MCAs adopted a report by the Powers and Privileges Committee that recommended the MCA be suspended to allow for investigations and determination on the allegations made against him.
The MCA, according to the report signed by committee Vice Chairperson Karen Ayika (nominated), is expected to appear before the Powers and Privileges Committee within 10 days.
But yesterday, two MCAs who sought anonymity for fear of victimisation, questioned the legality of the report claiming that it was the first time they were seeing it.
The MCAs claimed that the petition was taken to the assembly clerk when they were on recess.
Last month, the County Assembly suspended the MCA over claims of gross misconduct before Mboha filed a petition in High Court seeking to lift the suspension, and was eventually set aside though temporarily.
Mboha had claimed his life was in danger after being warned by a senior politician in the county to tread carefully following his suspension motion.
The Ward Rep said he was targeted over his stand on certain matters in the Assembly, adding that goons had been hired to harm him.
"Goons have been hired to eliminate me because of my stand on some issues going on in the Assembly," said Mboha.
