Babu will help settle DJ Evolve’s bill as moral obligation, not as a court order

The High Court on Tuesday reviewed Embakasi East MP Babu Owino’s bail terms from Sh10million to Sh5milion in the case where he is accused of shooting DJ Evolve.

Justice Luka Kimaru said there were no compelling reasons to deny the MP bail adding that he is not obliged to continue paying the DJ’s medical bill.

He further stated that the consideration for cash bail to be used for treatment for the DJ was not proper since an accused person is innocent until proven guilty.

"The accused person should continue paying the hospital bill as a moral duty to him, not as a court order...if he fails to pay it is up to him,” said Justice Kimaru.


In January, Milimani Chief Magistrate Francis Andayi directed the MP to deposit a Sh10million cash bail in four installments of Sh2.5 million to settle DJ Evolve's medical bill.

The magistrate also barred Babu from taking alcoholic drinks in public establishments during the pendency of the case.

Andayi ruled that Orinda’s family was unable to settle the hospital bill accruing at the Nairobi hospital where he was admitted after allegedly being shot by the MP.

So far, Babu has paid Sh4.4million and is to deposit Sh600,000 to secure his release.
