Nakuru cop who shot, killed two people to face murder charges

The Director of Public Prosecutions (DPP) Renson Ingonga has directed that Police Constable Nicholas Musau who shot and killed two people in a bar fight in Nakuru County last December be charged with two murder counts.

Ingonga made the resolve following the completion of investigations by the Independent Oversight Authority (IPOA) which had been tasked to conduct an independent and comprehensive probe and submit a report within two weeks.

"Having reviewed the inquiry file, the DPP is satisfied that there is sufficient evidence to sustain a charge of murder. The suspect should be charged with two accounts of murder contrary to Section 203 as read with Section 204 of the Penal Code," said the DPP.

Those shot during the brawl were waitress Ann Maina and the bar owner, Laura Kwasiru who succumbed to bullet wounds while two other people survived with serious wounds.

While confirming the shooting incident that occurred at the popular nightclub, Nakuru County Police Commander Samuel Ndanyii said the officer was supposed to be on duty but chose to go clubbing.

"The officer was issued a gun, a Jericho pistol with 15 rounds of ammunition because he was supposed to be on standby," he said.

Further investigations also revealed that the police constable is not new to controversy.

He on June 28, 2020, was among three people arrested for allegedly defrauding recruits during the Kenya Defence Forces (KDF) recruitment at Endebess Sub-County headquarters.

Musau, another officer, and a woman were accused of soliciting money from parents who had brought their sons and daughters to participate in the recruitment.
