Nick Mwendwa to be charged afresh with graft

A Kiambu court has summoned former Football Kenya Federation (FKF) president Nick Mwendwa to answer to fresh graft charges.

Kiambu Senior Principal Magistrate Kibet Sambu directed Mwendwa to appear in court on Monday, July 11.

Lead prosecutors Regional ODPP Joseph Riungu together with Kiambu ODPP Evelyne Onunga told the court to issue the summons against Mwendwa.

Riungu said the court was ready for Mwendwa to take plea on fresh charges as the prosecution has since reviewed the additional evidence.

However, Mwendwa was not available in court.  The investigating officer was also not in court to shed light if Mwendwa was aware of fresh charges. “I order that Mwendwa be produced in court on Monday 11 by the investigating officer,” ordered the court.

The Director of Public Prosecutions Noordin Haji yesterday confirmed that Mwendwa will face fresh charges.

Haji had earlier dropped Sh38 million graft charges against the embattled football administrator.

The DPP had prayed that the case should be adjourned to allow him review the evidence before commencing the hearing.

However, Mwendwa’s lawyers Eric Mutua, Charles Njena and Victor Omwebu opposed the application arguing that the State was delaying the hearing.

Lawyers argued that it was unfair to have the case adjourn further as Mwendwa had been in court since last year in November.

Milimani Anti-Corruption Court magistrate Eunice Nyutu dismissed DPP application prompting him to withdraw the case under section 87A of the criminal procedure code.

The section allows the prosecutor, with the consent of the court, at any time before judgment, to withdraw charges.

When the case started, the court declined to detain Mwendwa citing different amount of money.

In the case, the court heard that Mwendwa is being investigated for allegedly transferring Sh8.5 million from FKF account to his personal accounts and authorizing the fictitious withdrawal of Sh29.5 million from the federation’s account.
