Football Kenya Limited (FKL) is in a spot over a decision to retain a relegated team in the Nationwide League at the expense of a club that finished in tenth position.
The company yesterday announced it had demoted Kawangware United and retained Opera who finished among the bottom teams.
A correspondence from FKL Secretary General Thabit Mohammed shows Kawangware, a community-based club, is guilty of failing to pay match officials dues and are accused of ‘fraud’.
The ‘fraud’ in this instance is issuing of a cheque for Sh50,000 to FKL, which bounced.
Quoting article 16 (e) and 13 (c) of FKL constitution Thabit insists that rules of the league must be followed regarding this matter.
The first article reads: "Clubs defaulting on payment of such dues shall be eliminated from the league and demoted.
The second article states: "If the fraud centres on a team as a whole they shall be suspended from FKL competitions for only two years and relegated to the lower division"
Thabit says in his letter suspending and demoting Kawangware the club failed to heed several warnings and reminders to pay up or risk losing their place in the second tier league.
He says: "By the end of last season you had failed to clear the 2009 participation fees and other obligations amounting to Sh79,000."
