Lawyer Harun Ndubi faces charges over recklessness

City lawyer Harun Ndubi (pictured) has been charged with injuring a police officer through reckless driving.

He allegedly refused to give way at Makadara roundabout, along Langata Road in Nairobi, and in the process injured Police Constable Simon Mungai.

Mr Ndubi, who appeared at the Milimani Law Courts yesterday, faced a second count of failing to obey verbal directives given by a police officer in uniform.

The lawyer is accused of refusing to take an alcohol breathalyser test as ordered.

The prosecution said that being a driver of a Toyota Harrier, registration number KCA 820B, Ndubi drove the car without due care and attention causing the accident at around 6.30pm on February 3.

The officer is said to have been riding a Yamaha motorcycle, registration number GKB 891Q. 

Ndubi pleaded not guilty to the charges. The prosecution did not object to his release on bond and bail and was freed on Sh80,000 cash bail.

Through lawyer John Khaminwa, Ndubi put up a spirited fight to delay plea taking citing a case pending before the High Court that touches traffic law, but was unsuccessful.

“Your honour, traffic laws are full of flaws and I have moved to the High Court over the same,” said Khaminwa.

He added: “Your honour the charge of refusing to obey verbal instruction is a defective. We will challenge it in the High Court."

Khaminwa applied to be supplied with the charge sheet and documentary evidence the prosecution plans to rely on. The parties return to court today.
