Witness taken to task over forgery claim in petition

Juja MP George Koimburi (UDA) has asked the High Court in Kiambu to dismiss a petition seeking to overturn his election.

A witness appearing for the petitioner Aloise Kinyanjui, Jubilee's candidate, was taken to task by Koimburi's defence team over the allegations she levelled against the lawmaker.

Daisy Wangari, who was Kinyanjui's agent at Gachororo Primary School, had earlier told the court that she had been turned away from the polling station.

Wangari told Justice Roselin Wendoh that she received an appointment letter at Kinyanjui's house, along Kenyatta Road in Juja at around 3.35am on election day.

"When I got to Gachororo primary I gave the presiding officer my letter of appointment, oath of secrecy and a copy of my national ID. She just looked at the documents and returned them to me saying the stream was full," Wangari testified.

"Later, I took a look at form 35A. It bore my name, my alleged signature and ID number yet I never took part in the election as an agent," she added.

However, Wangari who is the 12th witness, was unable to explain why she did not report the alleged forgery to the police. She was also asked to shed light on the time she arrived at the polling station and when she left.

Kinyanjui wants the court to invalidate Koimburi's win, saying the election was not fair.

He claimed the election was marred with irregularities.

Koimburi garnered 39,413 votes in the hotly-contested election.
