A youthful garbage collector was recently fined Sh100,000 or in default serve two years in prison.
This was after the Makadara court found him guilty of breaking the legs of a man, who was looking for a vacant house.
Jack Onyango Juma is accused of grievously injuring Zakayo Mwanzui on his lower limbs with a metal bar on May 9, 2018 at Riverside estate in Ruaraka.
The court heard that Mwanzui, who is the complainant, checked into a residential plot where the accused was a garbage collector seeking a vacant room but found out that the plot was being rented out at a higher price by Sh1,000.
The accused is then said to have told the complainant to check on another room, which was on the top floor but hit him with a metal bar on his legs hence breaking them.
The complainant, in distress, called for help but the accused person claimed the victim was a thief and that he had stolen shoes.
The complainant was found lying on the floor bleeding from his legs with the accused slapping him. It took the intervention of a friend, who knew him, to rush Mwanzui to hospital.
However, Juma in his defence, told the court that he found the accused at the stairs and he looked scared after dropping some items. He learned later that he had stolen shoes and he called neighbours, who assaulted him and took him outside the gate where he was left in the custody of the caretaker.
However, the court found out that his claims were not corroborating with the evidence given by prosecution witnesses. He was found guilty and convicted.
