Waiter, 23, jailed for 15 years for defiling a minor

A 23- year-old hotel waiter has been sentenced to a 15- year imprisonment after he was found guilty of defiling a 16- year-old form two girl five years ago.

Dennis Ndiwa Oleitarian was convicted by Eldoret Senior Principal Magistrate Richard Odenyo.

The accused who has been out on bond had initially gone underground for about five months when he sensed danger ahead, but was later on arrested after a warrant of arrest was issued and his bond nullified.

The court heard that he committed the offence between the night of March 5 and 6, 2015, at Hawai Estate in Eldoret town within Eldoret West in Uasin Gishu County.

By the time of the incident, the victim was a form two student in a secondary school in Lugari Sub County.

The prosecution presented in court four witnesses.

While delivering the sentence the Magistrate said evidence adduced in court by prosecution sufficiently convinced the court that the accused was guilty of the offence contrary to section 8 of sexual offences act of 2006.

The court heard that the accused eloped with the victim when she was on her way to church and detained her for two days before the accused person’s sister rescued the girl and took her to her sister in the same estate upon learning that she was a minor and a schoolgirl.

In his mitigation, the accused told court he was remorseful for what happened and asked the court to forgive him.

“Your honour I am remorseful for what happened, I implore this court to forgive me,” he told the court.

“The court has heard your mitigation, having considered the evidence produced in this court, you are hereby sentenced to serve 15 years jail term.

He has 14 days to appeal the ruling.
