Man convicted for sodomising boy aged 13

A man was yesterday convicted of sodomising a boy aged 13.

Kakamega Senior Resident Magistrate Erick Malesi said the prosecution established its case against James Amakobe.

Amakobe was accused of defiling CB, a Standard Six boy, on February 3, 2019, at their Matioli village, Lurambi sub-county.

He was also charged with an alternative count of committing indecent acts with a minor.

The court heard that CB was playing with his peers when the accused approached them and asked him to accompany him to his house.

Since the complainant had known Amakobe as their neighbour, he followed him to the house.

When Amakobe was done, he released the complainant with a warning that he would harm him if he reported the incident.

The matter was circulated in school, making CB’s teacher enquire the authenticity of the information and confirmed it was true.

He was taken to Bukura Health Center where a P3 Form was issued.

Six prosecution witnesses presented a consistent narration of what transpired and dismissed Amakobe’s defense that the matter had been fabricated to settle personal scores.

The accused now stares at a sentence of not less than 20 years in jail as per section 8(3) of the Sexual Offences Act.

He sought leniency, saying he is remorseful and that he’s a first time offender.

The matter shall be mentioned on October 11.
