An appeal by a convict who stabbed Resident Magistrate Eunice Kelly six times with a screwdriver late last year will be heard on May 31.

This is after the prosecution applied for more time to prepare. However, the adjournment was opposed by defence lawyer Gacheru Ng’ang’a who said his client had been in prison for more than six months for assault, which was against the law.

"The basic sentence of assault is three to six months but my client has overstayed. It is an injustice for the prosecution to say it is not ready to proceed.

I oppose the adjournment. We have been waiting for the hearing for too long," he said.
