A man who claims to have had an affair with Mombasa Senator Emma Mbura has finally been charged with sending her offensive messages.

Kalinga Mgandi, an activist who claims that the tryst with Ms Mbura had wrecked his marriage, was taken to court on Monday but did not plead to the charges after the senator said that the prosecutor did not capture her complaints against Kalinga accurately.

Yesterday, Kalinga was brought before Mombasa Chief Magistrate Susan Shitubi to face the amended charges. He denied the charges and was released on a bond of Sh200,000 with a similar surety or cash bail of Sh100,000.

Among the words uttered by Kalinga in an audio clip that Mbura wanted to be included in the charge sheet were, “Mimi na wenzangu tukipanga line hapa itatoka Kongowea hadi Mtwapa of all we who slept with her in that capacity as a senator of this Republic”.

Kalinga who has been in police custody since Sunday denied the first charge, which stated that on March 13 using a telephone, he sent an abusive audio clip to the senator.

The message said: “You are not a woman enough if you are sleeping with your children’s age mate and snatching other women’s husbands tena iwe dawa all men on this forum be careful with this harlot/beast through Whatsapp groups Mombasa Community Forum, Mwahima Tena Tosha 2017, Mwahima Strategic Team and Likoni Constituency Forum”.

The second charge stated that he sent abusive audio clips on Whatsapp saying: “Useless senator you have lost focus and speaking silly wewe ni cobra, wewe ni mbaya kabisa.”

During court proceedings yesterday, Mbura smiled when Kalinga’s lawyer Leonard Shimaka asked her lawyer Christine Kipsang to ask her to reconcile with Kalinga and have the case withdrawn.

“Your honour, I am asking the honourable senator through her lawyer to initiate reconciliation between the two because since the court is an arbiter, it should recognise reconciliation in matters like this” said Mr Shimaka.

The magistrate said she had no objection if the two were willing to reconcile and told them to inform the court when they are ready.

In an interview later, Mbura said she was ready to forgive Kalinga on condition that he retracted his claims.

“I am ready to forgive him but he must accept that he has wronged me,” she said. The hearing of the case will start on April 28. The case will be mentioned on April 7.
