Nairobi, Kenya: Eight suspects including three police officers were charged with breaking into Eastleigh United Textile Mall and stealing property and money.
They were released on a bond of Sh3 million and a surety of a similar amount or a cash bail of Sh500,000. Defence team led by lawyer Cliff Ombeta said the court had ordered that three suspects be taken to hospital, but the prosecution had failed to do so.
"Your honour three of them sustained wounds of torture while in custody but they were taken for treatment after six days in efforts to cover up the scars," he said.
However, the prosecution through state counsel Eddie Kadebe said the torture claims were not substantiated with any evidence.
Chief Magistrate Daniel Ogembo said he would not consider the claims of torture. "I have noted the issue of torture has been raised only on plea for bail and no evidence has been submitted," he said.
The robbery took place on August 25 and 26.
