Director of Public Prosecution (DPP) Keriako Tobiko has cleared Siaya Senator James Orengo and former Secretary to the Cabinet Francis Kimemia of corruption allegations.
Orengo was among high profile members of the Coalition for Reforms and Democracy in the 175 list of names presented to Parliament by President Uhuru Kenyatta in March.
The other high profile CORD leader on the list is Machakos County senator Johnstone Muthama.
Orengo and Muthama were recently grilled by the Ethics and Anti-Corruption Commission (EACC) detectives over graft allegations levelled against them.
EACC, in its graft list of shame, had alleged that Orengo - during his tenure as Lands Minister irregularly sold a public land in Nairobi.
However, Tobiko in a press release yesterday said after reviewing Orengo’s file presented to his office by EACC, there was no sufficient evidence to prosecute him.
“EACC recommendations to close file accepted for lack of evidence accepted. File ordered closed,” read a brief from the DPP’s press release.
And EACC sent Mr Kimemia’s file to the DPP with recommendations for closure for lack of evidence.
The DPP confirmed he had received the file. “It’s true DPP has received from EACC file on Francis Kimemia recommending closure for lack of evidence,” said Tobiko.
