A Dutch woman seeking divorce from her Kenyan husband, John Lepil Lolkile, a ward representative in Samburu County, has sued the Director of Public Prosecutions and police for failure to charge him with bigamy.
Miriam Elisabeth Winkel has sued the DPP, the Inspector General of Police, the Officer Commanding Maralal Police Station and the Samburu County Commander for failure to act on several complaints she lodged against her husband.
In a petition lodged at the Nairobi High Court, Winkel accused the police of failure to act after she reported that Mr Lolkile had threatened her in 2012 and married a Samburu woman.
She also alleged that he had sent her abusive text messages and assaulted her. She says police in Maralal told her that the file was forwarded to the DPP but no action had been taken to date.
Winkel came to Kenya in 2003 and married Lolkile in 2008. She wants the court to order the respondents to act on the complaints she has lodged against her husband.
The petitioner through her lawyer John Khaminwa is seeking a court order restraining her husband and his agents from harassing and intimidating her.
Justice Judge Mumbi Ngugi directed that the case be transferred to Nakuru following a request by lawyer Khaminwa.
