The Court of Appeal sitting in Kisumu has thwarted efforts of Homa Bay’s Public Service Board chairman Mathew Ouma to temporarily stop a High Court case from proceeding.
A three judge-Bench comprising Justices Festus Azangalala, Onyango Otieno and Sankale ole Kantai refused to grant stay for a case that is expected to proceed at a High Court in Homa Bay next Monday.
Ouma had asked the court to adjourn the case because he was absent attending two sessions in Malindi.
While issuing orders on the matter, Justice Otieno noted that the first, second and third interested parties in the matter were not served with a notice of hearing hence the matter was worth an adjournment.
The matter was, therefore, adjourned and hearing will be fixed at the registry on priority basis.
