Attorney General Githu Muigai has affirmed that the contracts regarding the construction of the standard gauge railway from Mombasa to Malaba meet all legal requirements.
He said there was nothing to stop the project once the Treasury is satisfied with the financial structures and an agreement on the same reached.
Githu said the memorandum of understanding between the Ministry of Transport and China Road and Bridge Corporation as well as the bilateral agreement between Kenya and Uganda were in order and therefore gave a go ahead.
“From the legal side of the transaction, there is nothing that has happened that is a cause for alarm. We have neither changed our opinion nor altered it,” he said.
The AG, appearing before the Transport, Public Works and Housing Committee to answer to any legal issues surrounding the project, revealed to the committee the state law office had been involved in the whole process since the inception of the project.
Githu said they contributed professional input and not acted in a manner likely to make them distance themselves.
