An adopted son of a Kenyan citizen of European origin has moved to court seeking to be appointed the sole administrator of his father's Sh200 million land in Chaka, Nyeri County.
In his plaint, John Paul Kimaru Gordon has sued Chris Githinji Rwengo and 13 others for allegedly obtaining a certificate of confirmation of grant fraudulently.
Others named in the suit are Lucy Weru, Francis Kamau, Peter Kariuki, Speranza Njoki, Susan Wangu, Agnes Waruguguru, John Karanga, Peris Njoki, Mary Muthee, Margaret Karwe and Benson Kariuki.
The respondents also include Benson Kinyua Mwangi trading as Ole Nasra. According to Kimaru, he was tricked into entering into a sale agreement before receiving the certificate of confirmation of grant on the promise that the company would pay him Sh25.3 million for his land.
Through lawyer Gacheru Wambadi, Kimaru wants the court to set aside a consent judgment entered on September 20 last year.
He also wants the court to strike out the names of the respondents listed as beneficiaries, claiming they are not entitled to the estate of the late John Rennie Carrie Gordon.
Kimaru says he is entitled to be the administrator and to a one-third share of his father's 223-acre estate but he was only accorded a smaller share of 19 acres.
"The same is now wholly vested to the Ole Nasra Company as a purchaser who claims to have paid an amount of money I have never received.
“Gordon was survived by a wife and three children who rank higher in priority matters relating to the issue of the letters of administration and distribution of the estate," he said.
The matter will come up for ruling on January 27 next year.
