DPP now opposed to release of Sonko's secret tapes

The Director of Public Prosecutions (DPP) has appealed a court order to present taped conversations between Nairobi Governor Mike Sonko, his aides and a businessman charged with bribery.

Praful Kumar, a Nairobi trader, has been charged before Mombasa Chief Magistrate Eddna Nyaloti with trying to bribe Mr Sonko with Sh5 million in Malindi last year.

Through his lawyer Kithinji Marete, Mr Kumar applied before the magistrate last year for orders to have taped conversations between him and the governor's aides, Jacob Elkana, Stanley Kilonzo and Joab Odhiambo, made available. The trader also sought the taped conversation between him and the governor on August 20, 2018.

The orders were granted. However, the DPP wants the High Court to overturn these orders, arguing that they are unconstitutional and a violation of rights of privacy of the governor and his aides.

Justice Njoki Mwangi ordered the DPP to file his submission and the defence their reply within 30 days.
