The woes facing Kiambu Governor Ferdinand Waititu continued to mount on Wednesday with Members of the County Assembly (MCAs) hatching out a plan to oust him from office.
Biashara Ward MCA Mr Elijah Njoroge revealed he was preparing a motion to oust Governor Ferdinand Waititu from office which he said was 70 per cent complete.
“In two weeks’ time, the motion will be ready for tabling in the assembly. We will definitely send him home within the next 30 days and ensure he will no longer be our governor,” he said.
Njoroge said a majority of the MCAs were happy with the Tuesday's decision by a chief magistrate's court to bar the governor from entering his county offices until the corruption case against him is heard determined.
He said since the governor had been" barred from office" by the court there was no way he was going to work effectively for the people of Kiambu which is why they were seeking to oust him through the assembly.
"We have very solid grounds to oust the governor from office. It is our conviction that the motion will sail through in the assembly and be ratified by the senate," he said.
On TuesdayChief Magistrate Lawrence Mugambi barred Waititu from accessing his offices until the case is heard and determined.
Governor Waititu and his wife Susan Wangari denied graft charges on Monday. He was ordered to pay Sh15 million cash bail or bond of Sh30 million in a case involving a Sh588m tender scam.
Dissatisfied with the court decision Waititu moved to the High Court seeking review of his bail terms, and the effect of barring him from accessing his office.
The governor through his lawyer, Tom Ojienda, argued that the bond terms and conditions placed by Mr Mugambi were excessive and amount to a “constructive denial of bail without compelling reasons.”
Prof Ojienda argued the directive barring Mr Waititu from accessing the Kiambu County offices, effectively removes him from office as a governor which is in violation of the Anti-Corruption and Economic Crimes Act and Section 33 of the County Governments Act, 2012.
Kiambu speaker
The ward reps who addressed the media at the assembly also said that plans to impeach Kiambu Assembly speaker were in top gear.
Njoroge said there was no turning back in their bid to oust the Speaker, adding that there was overwhelming evidence to warrant his removal.
He said the speaker was being accused of abuse of office, fraud and nepotism which he indicated will be well-documented in his amended motion on the speaker’s ouster
