A family in Nairobi is seeking justice after the county and a Member of the County Assembly (MCA) took over their property despite a court order stopping their eviction.
George Ngacha Njiriri and his family want the County Secretary Patrick Analo and Kariobangi South MCA Robert Mbatia cited for contempt and jailed for six months for disobeying a court order that stopped them from taking their land in Buruburu Estate.
"The court expressly prohibited them from taking over the property or continuing with any construction but they have disobeyed the orders leaving us at the risk of losing our property," said Njiriri. Njiriri, alongside his family members, had sued Nairobi County and MCA for forcefully taking over the land.
According to the family, they were allocated the land by the defunct City Council of Nairobi in November 2002.
However, last year, Environment and Lands Court Judge Samson Okong'o ruled that the family did not genuinely acquire the title and allowed the county to repossess it.
The family then moved to the Court of Appeal where they got an order stopping the eviction.
