- If the Presidential election was conducted in accordance and compliance with written laws and legislations.
- If IEBC's 'non-compliance' with the constitution affected the validity of presidential results.
- If IEBC is applying and or interpreting the constitution observe and enhance the value of democracy at all relevant times.
- If IEBC arrived at declaration of the result in compliance with Article 81 of the constitution.
- If after counting the votes in polling stations, IEBC tallied and verified the count as required by Article 183(3) (c) of the constitution.
- If non-compliance, irregularities and improprieties affect the validity of the result.
- If Ruto was validly cleared as the president-elect.
- If rejected votes should be included in the final tally to determine if a candidate has hit 50 per cent plus 1 threshold.
- Whether the court should make a declaration or find that Chebukati violated several sections of Election Act No 37 of 2016.
