The police in Nairobi have arrested the owner of the building that collapsed in Tassia, Embakasi on Monday.

The building was still under construction and had reached the seventh storey.

It has marks made by National Construction Authority, signifying that it was not safe.

Embakasi OCPD Masai Makau said the house owner has been in hiding from Monday after the police summoned him for questioning.

He said the man was summoned through phone call but opted to communicate through text messages.

"It forced our officers to track down his phone and it was located in Kiambu, and that's where we arrested him and he is now in our custody," said Makau.

He had claimed he was bedridden but the officers found an able-bodied man.

Rescuers were still going through the debris, looking for one welder, Justus Mutisya who is said to have been trapped in the building.

Mutisya's relative said the rescue operation was slow.

A multi-agency team went to remove the debris yesterday as family members and friends waited in a tent erected opposite the Tassia Police Post.

The ground floor of the building already had tenants and it housed a pub, a mini supermarket and a barber shop.

One of the tenants said they saw dust coming from the building on Monday morning and informed the landlord who said there was a column that was being reinforced.

After some time, the construction workers walked out and told them to leave.

Mutisya, who is yet to be rescued, went back into the building to collect an item he had forgotten but never made it out.

The police said when his phone was tracked, the signal indicated he was still around the building.

The landlord, who is a road construction engineer, will be arraigned today.
