Hip hop recording artiste Hubert Mbuku Nakitare alias Nonini has declared that he will move to court should he not get an apology from content creator Brian Mutinda and Syinix electronics. Nonini said he was suing after his song, We Kamu, was used in their advert without his consent.
"Syinix Electronics decided to do a very brilliant advert using my song WeKamu. The only problem is they didn't ask for permission," Nonini tweeted.
Through social media, Nonini, through his lawyer, accused influencer Brian Mutinda of using the song in question for his financial gain, which amounts to copyright infringement.
"In this case, the influencer under the engagement of Syinix Electronics used our client's copyrights for his own financial gain and for Syinix Electronics' capitalistic gain without permission of our client hence amounting to copyright infringement," read part of the letter.
Stating their demands, Nonini and his team made it clear that they wanted a formal public apology from both the influencer and the company, followed by an amicable out-of-court settlement.

"Should you choose to ignore this demand, we have mandatory unequivocal instruction from our client to institute legal proceedings against both of you in a court of law," further said the legal letter.
Nonini's move comes barely two months after he terminated his membership with the Music Copyright Society of Kenya (MCSK), just days after voicing his disappointment at the Collective Management Organisations (CMOs).
"Insanity is doing the same thing over and over and expecting different results," he captioned a photo of a letter that showed the MCSK acknowledging his wish to terminate his membership.
Explaining his decision, Nonini said his actions were a way of fighting for change for a "better world and better leadership."
"The human society is the extension of the individual. If we really want a radical change in anything, if we want a better world, better leadership and better structures, we need to change the things that are not working by understanding you have the power individually," said Nonini.
