Kenya: Former Embakasi MP Ferdinand Waititu got a reprieve when the High Court declined to strike out evidence from two of his witnesses.

High Court Judge Richard Mwongo yesterday ruled that Nairobi Governor Evans Kidero will not suffer any prejudice if the affidavits of Waititu’s two witnesses are accepted in court.

Dr Kidero’s lawyer Tom Ojienda had pleaded with the court to strike out the affidavits of Edward Chege and Ibrahim Ahmed on grounds they were not tested.

Ojienda told the court the two witnesses swore affidavits in support of Waititu’s petition but they were excluded from taking the witness box to enable him cross-examine them.

Waititu’s lawyer Harrison Kinyanjui, however, asked the court to decline the prayers sought saying the evidence in chief need not be subjected to cross-examination.

Yesterday, Embakasi Constituency Returning Officer Fionah Nduku defended Kidero, saying he was validly elected.
