Kenya: Teachers Service Commission (TSC) has once again been given more time by the Nakuru High Court to process data for payment of pension to 52,000 retired tutors.

On February 21, TSC was given 45 days to process particulars of retired teachers and directed to obey court orders. Yesterday, Justice Anyara Emukule gave another 60 days to the teachers’ employer to comply with court orders which arose after tutors sued TSC over accrued pension in 2006.

After a protracted court battle with the commission, the court of appeal ordered the commission to release Sh16.7 billion to retired teachers on November 2010, this being unpaid pension. Deputy legal affairs official Allan Sitima told the court TSC had audited 18,612 names from over 180,000 files which had been forwarded to director of pensions for processing.

“I can confirm to court TSC has audited over 180,000 files manually touching on retired teachers. TSC found 18,612 cases involving teachers who retired, died or were released to other public institutions,” Sitima told the court. However, lawyer Dominic Kimatta, counsel for the retired teachers, opposed the adjournment sought by TSC.
