A contractor who allegedly obtained Sh44 million from a construction company to secure a tender from a college in Kakamega County has been charged.
Duncan Wanga Ambuche appeared before the Milimani Chief Magistrate, Ms Susan Shitubi, on Wednesday and denied conspiracy to defraud, uttering a false document and obtaining money by false pretence.
Ambuche was accused that on diverse dates between August 14, 2020 and September 28, 2021, at Queensway House, Nairobi, with others not before court, he conspired to defraud M/S Shuria construction company of Sh44 million by issuing a forged award letter for a tender.
According to the charge sheet, the tender was at the Bukura Agricultural College. “You pretended that the tender was a genuine one issued by the Principal, Bukura Agricultural College,” the charge sheet stated.
He was also accused that on December 21, he uttered a document namely tender award notification letter dated December 18, 2020 for the proposed construction of a perimeter wall at Bukura Agricultural College to M/S Shuria construction company limited.
Court papers stated that Ambuche purported it to be a genuine letter issued by the college.
The other count was that on diverse dates between August 14, and September 28, 2021 along Kaunda street in Nairobi, with others not before court, he fraudulently obtained Sh44 million by falsely pretending he was in a position to secure Shuria construction company a tender at the college. He was released on Sh100,000 cash bail.
The case will be mentioned on April 16.
