The Law Society of Kenya has termed move by Ethics and Anti-Corruption Commission (EACC) to probe Supreme Court Chief Registrar Esther Nyaiyaki as unconstitutional.

EACC had called for the submission of documents that relate to the proceedings of the Supreme Court of Kenya Presidential Petition No. 1 of 2017.

The anti-graft commission also ordered the Registrar of the Supreme Court, Ms. Esther Nyaiyaki to record a statement in furtherance of an investigation that it launched following receipt of a letter of complaint from M/s Kilukumi & Company Advocates acting for their client, one Rashid Mohammed.

Ms Nyaiyaki oversaw a team of ICT specialists appointed by the Judiciary to examine Independent Electoral and Boundaries Commission election materials used in the succesful petition filed by Opposition leader Raila Odinga, against the election of President Uhuru Kenyatta.

The Supreme Court determined that a huge number of forms 34As used to declare the presidential results at the polling stations were duplicated, while others had no evidence of being stamped or signed contrary to the law.
