Three-year jail term for husband who beat wife to death over Sh600

A man who beat his wife to death over the alleged loss of Sh600 will spend three years in jail and an equal amount of time under probation.

Stanley Keino, initially charged with murder was sentenced for manslaughter after he took up an offer by the State to plead guilty to the lesser offence.

The man appeared before High Court judge Mumbi Ngugi who noted that the only way he could learn a lesson – that domestic violence is wrong and cannot not be excused – was by spending some time behind bars and thereafter serve a non-custodial sentence.

“Given the circumstances, the accused must take responsibility for his actions which resulted in the death of his wife. Accordingly, this Court sentences him to serve three years’ imprisonment and a further three years on probation,” said Justice Ngugi.

It happens that both the accused and his wife Rose Keino were both drunk on the fateful evening of March 6, 2016. According to court records, the man got home at around 6.00 pm after a drinking spree and found the deceased with their three children. The woman was also drunk.

It is then that an argument ensued over Sh600 that was missing in the house, with each blaming the other over the loss. This ended up in a fight in which Keino grabbed a piece of wood and attacked his wife.

“I have considered the circumstances of this case and the mitigation by the accused, as well as the report from the probation office. The accused pleads for leniency and promises to be a good member of society. I note also that both the deceased and the accused were drunk at the time the fight that resulted in the deceased’s death occurred,” the judge noted.

She added: “However, it is not lost on the Court that a human life, the life of the wife of the deceased, and the mother of five children, was lost. It was lost in the course of domestic violence, and it is noteworthy that it is the accused who took a stick and started beating the deceased all over her body. The Court further notes that the accused sometimes resorted to domestic violence as indicated in the social inquiry report. This is a practice that must not be countenanced nor condoned.”

Plea for leniency

The evidence adduced before the lady justice indicated that the woman fainted, but out of love the accused lifted her and dumped her in bed to sleep, hoping to solve the matter the following day.

He came to realise that his wife was dead at 3.00am when their baby started to cry. He tried to wake her up so that she could breastfeed the baby but she did not respond.

It is then he left the house to inform his brother, who was also a neighbour what had happened and disappeared for two days. He then surrendered himself to the area assistant chief. Medical reports indicate Keino’s wife died as a result of spleen and lungs injury, which caused internal bleeding.

The man pleaded for leniency saying that he had time to reflect over his actions for the eight months he was in remand and had opted to give his life to Christ. He said that he was remorseful and had resolved to never get back to being an alcoholic.
