Gatundu MP Moses Kuria restrained from commenting on Mandera bus attack

Gatundu, Kenya: Gatundu South MP Moses Kuria has been restrained by a Nairobi court from making comments on social media over the recent terror attacks in Mandera County.

The MP was in court yesterday for the mention of another hate speech case over comments he allegedly made on social media about the Gikomba market terror attack in May.

State counsel Nicodemus Maingi asked the court to restrain Mr Kuria from commenting on the attack, saying his comments were bordering on incitement to violence and criminality.

The prosecutor alleged that on November 24, Kuria through a hashtag on Twitter, #killyourown, made the comment, which according to prosecution amounted to incitement to violence and ethnic contempt.

However, Kuria's lawyer John Mburu opposed the application and urged the court to dismiss it, saying Kuria made the comments out of good faith. In his ruling, Milimani Senior Principal Magistrate Enock Cherono warned the MP against making such comments. "The moment the accused assumed the status of a senior citizen, he should at all times exercise restraint since he can air such sentiments in Parliament," said Cherono.
