Ethics and Anti-Corruption Commission asks court to dismiss case

Kenya: The Ethics and Anti-Corruption Commission has asked the High Court to throw out a case filed by four traffic police officers who were nabbed taking bribes along Thika Road and Waiyaki Way.

In a response to the petition before Justice Mumbi Ngugi, EACC said the four had not demonstrated how their rights would be infringed by being arraigned to answer to corruption charges.

"Sufficiency or otherwise of the evidence to support the charge goes to the merit of the decision of the Director of Public Prosecutions and not the legality of the decision," the graft watchdog, through its lawyer Diana Ogula, argued.

The four officers were arrested last month.

The case will be mentioned on January 23, 2015.
