Mother of slain Kwale girl sues IG David Kimaiyo, DPP

KWALE COUNTY: The mother of 14-year-old Kwekwe Mwandaza, who was shot dead by police last month, now wants a court to issue an arrest warrant for the officer who shot her daughter.

Umani Zani, through her lawyer John Khaminwa, said investigators at Kwale Police Station were reluctant to apprehend the officer.

"No arrests have been made despite the fact that the police know who stormed into Hussein Zani's house and killed Kwekwe," said Ms Zani in a case filed in court yesterday.

She has also sued Inspector General of Police David Kimaiyo, Director of Public Prosecutions Keriako Tobiko and Independent Policing Oversight Authority (IPOA) for alleged negligence.

She has accused Mr Kimaiyo of failing to exercise his duty since he did not order the arrest of the officers who are under his command.

Kwekwe, a Standard Six pupil, was killed on August 21 and buried three days later under mysterious circumstances but her body was exhumed last week after the court ordered a fresh postmortem.

CAUSE OF DEATH

The investigation report is reportedly with the DPP though doctors who carried out the second postmortem have ruled out the earlier cause of death.

The initial report indicated that Kwekwe died of cardiac arrest as a result of bullet wounds but last week's report by Government Pathologist Johansen Oduor showed that her death was due to a single bullet from high-powered rifle shot to her head and another one that bruised her chest.

Wednesday, Zani also accused the DPP of failing to use his powers to direct Kimaiyo to investigate the matter.

The woman accused IPOA of failing to use powers vested in it to investigate any complaint related to disciplinary or criminal offences committed by the police officers.
