Mathare by-election: Semelango to know fate on Monday 28

NAIROBI, KENYA: Parties in a case where the former Youth Development Fund Chairman Gor Semelango wants the Mathare By Elections slated for August 7 postponed, have been directed to file and serve their responses by July 25.

High Court Judge Justice Mumbi Ngugi further asked the parties to exchange their skeleton submissions by Friday in readiness for the inter parties hearing next week.

Semalengo wants the By Election delayed on the grounds that the Independent Electoral Boundaries Commission (IEBC) locked him out of the electoral race.

"I received instructions this morning. I need more time to put in a response," IEBC lawyer Edwin Mukele told the court.

On Tuesday, Semelango filed an urgent application where he wants the court to postpone the By Elections slated for August 7.

He says that the electoral body through its Mathare's returning officer refused to issue him with a nomination certificate.

The returning officer, High Court Judge Justice Mumbi Ngugi heard, denied him the nomination certificate on the basis that he did not resign from his post Chairperson of the Board of the Youth Enterprises Development Fund within the six months period as stipulated in the Elections Act.

Semalengo, a political aspirant stated that his constitutional rights have been violated by being denied the opportunity to vie and that of his supporters as they have also been denied the chance to elect him.

Justice Ngugi directed him to serve the Electoral body with the suit papers. She further asked them to come back on Thursday for further directions.
