Court upholds election of Kisumu West MP Olago Aluoch

KISUMU, KENYA: Petition challenging the election of Olago Aluoch as the Kisumu West Constituency Member of Parliament has been dismissed.

Kisumu High Court upheld the March 4 election of the MP dismissing petition filed by Roza Buyu at a Sh1.5 Million cost.

Justice Hillary Chemitei ruled that despite instances of discrepancies in forms 35 and 36, agents of Buyu signed forms 35 which validated the results.

The petition was dismissed with cost not exceeding Sh1.5 Million. In the ruling, the judge however noted that there were great errors filed by the Independent Electoral and Boundaries Commission (IEBC) where officials did not sign form 36 insisting that accuracy in an election should not be compromised.

“Statutory  forms should be written without alterations,” he said. He however said this was not reason enough to nullify the votes.

He stated that the nullification could have been possible if there was enough evidence to warrant the same.
