Journalist seeks to stop Ocampo probe

An investigative journalist wants International Criminal Court prosecutor, Luis Moreno-Ocampo restrained from conducting investigations against him.

Dr David Nyekorach-Matsanga wants the prosecutor to stop conducting further interviews or investigation against him, which were commenced on April 12 and 13.

He claims Moreno-Ocampo will not exercise the independence required of his office in conducting the said interview/investigation or in making fair decisions concerning the matters under investigation.

“The applicant has reasonable grounds to believe the evidence submitted by him during the interview/investigation establishes that the prosecutor relied on notable intermediaries/political activists, Prof Makau Mutua and Mr Maina Kiai,” he alleges in the case filed before the ICC.

He claims that Mutua and Kiai have interfered with the process, which is the subject of investigation against him.

The two, he further claims, published newspaper articles in which they made adverse comments against him that might influence the outcome of the Kenyan cases before the ICC.

“These articles tend to establish that both acted inappropriately and prejudicially in respect of information they acquired in their role as intermediaries for the prosecutor,” he claims.

Matsanga claims that prior to filing the application before court, he afforded the prosecutor an opportunity to disqualify himself and his office from the interview/investigation.
